Revive Files Opening Brief in Rio Mesa Litigation
After six months of intense research Revive the San Joaquin and its partners Madera Oversight Coalition and the Dumna Tribal Council file our opening brief (below)against the Tesoro Viejo Developments. The lawsuit challenges that the approval of the Specific Plan and other associated planning documents were grossly inadequate in that local policy and regional and State laws were widely ignored. The lack of coordination with State, regional, and federal agencies was prevalent and this led to poor CEQA accountability and a grossly uninformed vote by the Board of Supervisors. The lack of a water supply, the destruction of Native American cultural resource sites, poor traffic modeling, and a complete disregard for air quality mitigations turned out to be the major points of argument in the case.
The case was split into separate cases including a CEQA challenge and also a pattern and practice suit that will allege the County of misconduct and a repeated pattern of irresponsible planning. A separate case against Northshore at Millerton, another Rio Mesa Development approved on the same day, has been moved to Tulare County and is also expected to be split.
